Website Terms and Conditions

These terms and conditions (“Ts&Cs”) apply to www.lawreycalabronaturopath.com and are important - please read them carefully before you start using our website (“Website”).

These Ts&Cs, our Privacy Policy and any other rules or guidelines that are posted onto the Website from time to time (together, the “Terms”) are entered into between “you”, the user, and Lawrey Calabro and Lawrey Calabro Naturopathy (ABN 32 605 102 379) (“we”, “us”, “our”). By accessing and using our Website, you agree to these Terms to the extent they apply to your use. If you do not agree, please stop using the Website. Booking-specific terms, including fees and cancellation conditions, will be provided before you confirm a booking.

Our Privacy Policy explains how personal information is handled; acceptance of these Terms does not replace any consent required by law.

We may update these Terms by posting an updated version and update date on the Website. Material changes will be brought to your attention where reasonably practicable. Changes apply prospectively and do not retrospectively change confirmed bookings or accrued rights without your agreement, except as required by law.

1 - LICENCE TO USE THE SITE

1.1 - Our licence to you. We hereby grant you a non-exclusive, non-transferable licence to use the Website in accordance with the Terms.

1.2 - Nature of the service. You acknowledge and agree that:

we may reasonably alter, maintain, interrupt or discontinue Website features, with notice where reasonably practicable; this does not remove our obligations for confirmed bookings or payments already received;

we use third-party systems, including Alveya for Website hosting and SimpleClinic for clinic management; Heidi AI scribe may be used in consultations only with your prior consent, as explained in clause 3.3 and our Privacy Policy; and

the Website may not operate on a continuous basis, and may be unavailable from time to time (including for maintenance purposes).

2- YOUR RESPONSIBILITIES

2.1 - Age. Any persons using this Website for the purpose of purchasing any services or products offered on it at any time must be at least 18 years of age or accompanied by a parent or legal guardian.

2.2 - What you must do. In accessing and/or using the Website, you must:

Comply with all applicable laws and you must not use the Website for any purpose that is unlawful or in breach of the Terms;

Not alter or modify any part of the Website;

Not attempt to "hack", decompile, disassemble, or reverse engineer any software deployed in connection with the Website. This includes "phishing", “mining”, accessing "hidden" URLs, trying to guess users’ passwords, attempting to trigger remote code for the purpose of accessing data or material you would not otherwise have access to;

Not knowingly transmit any virus, corrupt files or any other software or function that may damage the operation of the Website or other disabling feature to the Website, or which is designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of any part of the Website;

Not use or launch any automated system, including "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser;

Not circumvent, disable, or otherwise interfere with security-related features of the Website;

Not alter or remove any copyright statement or other notice of ownership of Intellectual Property Rights which accompany the Website.

2.3 - Take your own precautions. You must take your own precautions to ensure that your process for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system.

2.4 - Users outside Australia. Our Website is operated by us from Australia. The information on our Website may not be appropriate or available for use in other jurisdictions. If you choose to access our Website from a jurisdiction other than Australia, you do so on your own initiative and you are responsible for compliance with any applicable laws of that jurisdiction.

3 -WARRANTIES

3.1 - Warranty. The Website is provided “as is” and “as available”. While we take reasonable care, we do not guarantee that the Website will always be uninterrupted, error-free or free of harmful code, or that general Website information will meet your individual needs. These qualifications do not exclude any guarantee, right or remedy that cannot lawfully be excluded.

3.2 - Liability and consumer rights. Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law or another applicable law. We remain responsible for our acts and omissions where the law requires. Subject to those rights, we are not responsible for loss arising from events beyond our reasonable control or your misuse of the Website, except to the extent our conduct caused or contributed to that loss. Any exclusion or limitation applies only where lawful and fair in the circumstances.

3.3 - Artificial intelligence and clinical documentation. With your prior consent, we may use Heidi AI scribe to support consultations and prepare draft clinical notes, allowing your practitioner to focus more fully on your consultation. We will explain its use before seeking consent to process relevant personal and health information. You may decline or ask us to stop, and manual notes will be taken instead without affecting access to care. Your practitioner reviews and corrects draft notes before they form part of your clinical record and remains responsible for clinical decisions and final documentation. AI outputs can contain errors. Our use of AI does not remove our professional or legal responsibilities. See our Privacy Policy for further information.

3.4 - Your responsibility for breaches. You are responsible for your own unlawful use of the Website and breaches of these Terms. Any claim against you will be limited to reasonable loss directly caused by your breach, taking account of our contribution and our obligation to take reasonable steps to reduce loss. You are not automatically liable for unauthorised use of an account that you did not cause or permit. Please notify us promptly if you become aware of unauthorised access. These Terms do not require you to indemnify us for our negligence, misconduct or breach of law.

4 - COPYRIGHT AND TRADEMARKS

4.1 - We or our suppliers own copyright in the contents of our Website. No part of our Website may be distributed or copied for any commercial purpose, and you are not permitted to incorporate the material or any part of it in any other work or publication (whether in hard copy, electronic or any other form) without our prior written consent. You may not frame any part of our Website material by including advertising or other revenue generating material. Further, you may not remove or alter any trademarks or logos that appear on any material on our Website.

5 - COOKIES & LINKING

5.1 - Cookies. Our Website may use cookies to monitor browsing preferences. Please see our Privacy Policy for details and your browser settings for cookie controls. We obtain consent where required by law; use of the Website alone is not treated as consent to use health information for advertising.

5.2 - Linking. The contents of our Website may include links to third party materials. We do not control linked sites or their privacy practices. Subject to your non-excludable rights, we are not responsible for third-party content or dealings except to the extent our own conduct caused or contributed to your loss. The linked sites are provided to you only as a convenience, and the inclusion of any linked site does not imply any endorsement of it by us or any association with its operators. We may reasonably request removal of a misleading, unlawful or infringing link to our Website.

6 - INFORMATION AND MATERIALS

6.1 - The content on this Website is not comprehensive and is provided for general information and education only. It does not consider your individual or specific needs, objectives or circumstances, and it is not professional advice.   You should obtain professional or specialist advice before taking or refraining from any action on the basis of any information on this site. Before selecting any product or service or acting on any information contained on our Site, you should consider the appropriateness of the information, product or service, having regard to your personal circumstances, goals and needs.

6.2 - Consultations and Telehealth. Our consultations are provided by Telehealth to clients in Australia. Individual care requires an appropriate consultation, relevant health information and informed consent. Please provide accurate information about your health, medicines and supplements, and let us know if your circumstances change. Naturopathic care is complementary to appropriate medical care; results vary and no particular outcome is guaranteed.

6.3 - Fees and bookings. Consultation and package prices, inclusions and payment requirements will be disclosed before purchase. Prices are in Australian dollars. Testing, supplements and other services are included only where expressly stated. Changes to advertised prices do not change an already confirmed booking or purchased package without your agreement. Free discovery chats, where offered, do not attract a monetary cancellation fee.

6.4 - Cancelling or rescheduling. Your appointment time is reserved especially for you. Please give at least 24 hours’ notice to cancel or reschedule without a cancellation fee. Cancellations with less than 24 hours’ notice will be billed 50% of the booked consultation fee, subject to the reasonable-loss limit below. Requests to reschedule with less than 24 hours’ notice are considered at the practitioner’s discretion and are subject to an available opening. A fee of 50% of the booked consultation fee applies unless waived by the practitioner. If you miss an appointment without notifying us, a fee of up to 100% of the booked consultation fee may apply. Any fee will be limited to our reasonable loss, taking account of costs saved and whether the appointment is filled by another client. Notice means calendar hours; a Monday 10 am appointment requires notice by Sunday 10 am.

6.5 - Managing your appointment. You can confirm, reschedule or cancel online using the link in your appointment confirmation email. If your appointment is less than 24 hours away, contact Lawrey directly by email at [email protected] or text 0435 394 565. Notice is measured from when your email or text reaches us, even if we respond later. Please do not use social media for appointment changes. Fees may be reduced or waived for unexpected illness, emergencies or other difficult circumstances; contact us as soon as possible.

6.6 - Late arrival and technical issues. Please be ready at the scheduled time. A late start may shorten your consultation, with the usual consultation fee applying. If you cannot connect, call or text promptly; we may continue by telephone where appropriate. If an unexpected technical failure prevents the consultation, we will discuss an alternative or reschedule without a cancellation fee. If you have not joined within 15 minutes and we cannot reach you, the appointment may be treated as missed under clause 6.4.

6.7 - Prepayments and packages. An applicable cancellation fee may be deducted from your prepayment, with the balance refunded or credited according to your preference. For a package appointment, the fee is based on the consultation component allocated to that appointment and disclosed at purchase, not the total package price. We will not both charge a cancellation fee and forfeit the same appointment. Requests to cancel unused package services will be assessed under the package terms disclosed at purchase and applicable consumer law. Any retained amount must be lawful and reflect services provided or reasonable costs or losses, without double charging. Statutory refund rights are not affected.

6.8 - If we cancel. If we need to cancel, we will notify you as soon as possible and offer another appointment. Payment for the cancelled consultation can be transferred or refunded according to your preference. This does not limit other remedies available under the Australian Consumer Law. Cancellation fees do not apply where you are legally entitled to cancel without charge.

7 - SUSPENSION AND TERMINATION OF USER ACCOUNTS

7.1 - Reasonable management of access. Where the Website provides an account or login, we may investigate suspected breaches and take reasonable, proportionate steps to protect the Website and its users.

7.2 - Suspension or termination. We may suspend or terminate Website access or an account where reasonably necessary because of a material breach, unlawful or harmful activity, a security risk, or discontinuation of the relevant service. Where appropriate, we will give notice, explain the reason and allow a reasonable opportunity to correct the problem. Immediate action may be taken where necessary to address urgent risks or comply with law.

7.3 - Effect of suspension or termination. You must not bypass a lawful suspension or create another account to avoid it. Account suspension does not remove your rights concerning prepaid Services, access to health information, complaints or other non-excludable rights. Please contact us to arrange an alternative means of accessing information or resolving a booking.

7.4 - Inactive accounts. Where appropriate, we may close an inactive Website account after reasonable notice. Closing an account does not authorise deletion of health records that must be retained by law, or forfeiture of amounts to which you remain entitled.

8 - GENERAL

8.1 - Disclaimer. Nothing in this disclaimer will limit or exclude any liability that may not be limited or excluded by applicable law. Any information on this Website is provided within the scope of our expertise and is not a substitute for independent professional advice. Our responsibilities and your consumer rights are preserved as set out in clause 3.2. General Website content is not individual clinical advice. You should obtain independent advice from a qualified professional that is relevant to your individual circumstances before making any decisions or taking any action.

Any information on this Website is not a substitute for consultation, diagnosis, and/or treatment by a qualified health professional. If you have specific questions or concerns about any medical matter, you should consult your doctor as soon as possible. If you think you may be suffering from a medical condition, seek appropriate medical attention. In an emergency in Australia, call 000. Do not delay seeking, disregard, or discontinue medical treatment because of information on this Website.

8.2 - Waivers. If a Party does not exercise a right or remedy fully or at a given time, the Party may still exercise it later. A waiver by either Party in respect of a breach of a provision of the Terms by the other Party will not be deemed to be a waiver in respect of any other breach and the failure of a Party to enforce at any time any of the provisions of the Terms will in no way be interpreted as a waiver of such provision.

8.3 - Entire agreement. The Terms contain the agreement concerning use of our Website, together with booking or package terms expressly agreed before purchase. They do not override statutory rights, clinical consent requirements or representations on which you are legally entitled to rely. Specific booking terms prevail over general Website terms to the extent of inconsistency, subject to law.

8.4 - Prohibition and enforceability. If any term or provision of the Terms is held illegal, invalid, or unenforceable under any applicable law, that term or provision will be severed, and the remaining terms and conditions will be unaffected.

8.5 - Survival. Clauses 3 (Warranties) and 4(Copyright and Trademark) together with any other clauses which contemplate that a Party has any rights or obligations after the Terms expire or terminate, survive the expiry or termination of the Terms.

8.6 - Governing law. These Terms are governed by and will be construed in accordance with the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
